If IBM wins the first round, SCO might give up or at the very least those that might be scared to invest in Linux will see that SCO's case isn't very rock solid. And IBM or Red Hat may be able to get an injunction against SCO like SuSE did in Germany, basically saying they can't claim their code is in Linux until they prove it first!
